Texas Senator John Cornyn Pushing Gun Control

Texas Senator John Cornyn, a man who lies to his constituents and donors about his support for the Second Amendment, has now co-sponsored a bill that has the radical anti-gun Left salivating.

Senator Chris Murphy of Connecticut is one of the most far-left, anti-gun radicals in all of Congress. He is a co-sponsor of Cornyn’s bill. He called it a “Big deal.” Here is what he wrote about the bill when it was first introduced:



The bill in question is S.2135 and is titled the Fix NICS Act of 2017. It was ostensibly introduced in response to the mass murder committed at a Texas church in the small town of Sutherland Springs, Texas in November. It has been learned that the murderer, Devin Kelly, had been found guilty of domestic abuse when he was in the Air Force. His conviction prohibited him from being able to legally purchase or possess a firearm. However, the Air Force never entered his conviction into the database used for federal background checks as they were required to do by law. As a result, a man who was prohibited by law from purchasing a firearm was able to do so.

The stated purpose of this proposed legislation, in theory, seems to be a good one. It primarily seeks to strengthen the background check system by ensuring that all disqualifying incidents be reported into the NICS system. The problem lies in the fact that the current law is far more restrictive than the vast majority of people understand. So much so that if our existing gun laws were strictly enforced, as this bill seeks to do, it would prevent millions of law-abiding Americans from purchasing firearms. Here is how Michael Hammond writing at Townhall explains it (and he is exactly right):

The Cornyn-Schumer-Feinstein-Blumenthal-Murphy bill is S. 2135.  And what it would do is push hard to make sure that the agencies and states submit every conceivable eligible name the the FBI’s list of persons banned from owning guns, called the NICS list.

“Enforce the law” has been a mantra for squish Republicans.  So, you may ask, what’s wrong with making sure every single eligible name reaches NICS?

The answer is that the “dirty little secret” of NICS is that the prohibited persons law (18 U.S.C. 922(g)) and its interpretation under a 2007 law and its regulations are so perverse that, if actually enforced to the letter, they would ban guns from millions of additional law-abiding Americans.

 

Here are a few categories are of particular concern:

Parking Tickets / Traffic Tickets / Minor Offenses

The bill would prohibit people who are “fugitives from justice” from purchasing firearms. Sounds perfectly fine, right? WRONG!

If you have an unpaid parking ticket somewhere in the country, then you are technically a “fugitive from justice.” How about the ticket you got for failing to come to a complete stop at a stop sign? Did you forget to pay it? Then you’re a fugitive from justice! Jaywalking? Littering? Talking on your cell phone while driving? Congratulations, you are a fugitive from justice and Senator John Cornyn of Texas wants to strip you of your Second Amendment rights!



Medical Marijuana, Prohibited Substances

Ever smoke pot? No guns for you!

Get busted smoking pot at some point in your life? Sorry, you’re screwed.

Ohhhh…. you were just “experimenting” in college. Tough! I hope you didn’t waste time learning about your constitutional rights, because you no longer have them!

Yes, even you “medical marijuana” users will be banned from purchasing firearms. Oh, you live in a state that allows it? Your doctor prescribed it for you? Too damn bad! You are a danger to the country and have lost your constitutional right to keep and bear arms. You can thank John Cornyn.

Mental Health Treatment

Have you ever been treated for any mental health issue? Well, I hate to upset you, but John Cornyn says you have no right to protect yourself or your family with a gun.

And I’m not just talking about the severely bi-polor or paranoid schizophrenics. How about mild depression? Ever seek therapy to help you cope with the death of a loved-one, or to deal with the emotional pain following a divorce? Sorry, the Second Amendment no longer applies to you, John Cornyn says so. Well, he may not say so specifically, but his bill would eventually lead to it.

Slippery Slope – The Real Danger

This bill will lead to further restrictions not included within its text. For example, as I pointed out, the bill doesn’t specifically state that people diagnosed with depression will be prohibited from purchasing firearms, but it doesn’t need to. Just give it some time and this interpretation will be added by regulation or guidance letters from the ATF to state attorneys general. That is how this works. Congress passes a law and bureaucrats expand the scope of its meaning through regulation, both official and informal.

Want an example of what I’m talking about? Take Title IX, passed in 1972. Its purpose was to ensure that women receive the same educational opportunities as men, and prohibited discrimination on the basis of sex. The simple text of the law passed by Congress reads as follows:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

This law has since been bastardized to a grotesque degree and is used in manners never intended by Congress. The Obama Administration, simply by issuing a letter (Dear Colleague Letter 2011), has used this law to deny due process to men accused of sexual misconduct on college campuses. The letter instructs every college and university in America which receives federal funds (and that is almost all of them), to comply with a whole litany of outrageous procedures and anti-constitutional adjudicative processes that were never contemplated by Congress. For all intents and purposes, these bureaucratic dictates are now treated as law, even though no member of Congress ever voted for them. This is the bureaucratic tyranny under which we live, yet seldom discuss.

Title IX is but one example. This happens with all manner of laws. They are passed in one form, and become something completely different (and always more oppressive) once the career bureaucrats and left-wing political hacks who populate the various administrative agencies begin to implement them. This will happen with John Cornyn’s “Fix NICS Act.” Mark my words!

The risk of this type of bureaucratic expansion of the law is even more acute in this case, because state attorneys general will also be able to get in on the act. A left-wing state attorney general will be able to interpret the federal law broadly and instruct state agencies to report people and incidents not specifically covered by the law, to the national database.

This is scary stuff. It is a slippery slope of the worst kind. The next Democrat President will be able to expand this bill by regulation and over-broad interpretation to add millions more people to the NICS database, thus prohibiting them from purchasing firearms. There is no due process. It is simply a bureaucratic process by which the government can easily strip you of your rights. If you are in the system, then you will not be able to purchase a firearm, period. And good luck trying to get yourself off!

This bill must be opposed. Every co-sponsor, and anyone who votes for it, must be defeated when and if they run for reelection. I know that not all of them will be, but all of them should be. I have focused on John Cornyn thus far because he is a particularly loathsome actor in all of this. First, he represents the people of Texas who would overwhelming oppose this bill if they actually knew what was in it. Second, he lies to his constituents about his support for their Second Amendment rights. Third, he is lying about the particulars of this bill. Finally, his sponsorship of this bill is a disgusting political move designed to give cover to the far-left gun grabbers. He is the senator from the state in which this recent mass shooting took place, and is using that fact to shield this bill from criticism. He is also a Republican from Texas. This fact alone allows the bill’s proponents to argue that this bill is not a radical piece of gun control legislation, but rather a reasonable common sense step to ensure that guns don’t end up in the hands of people who shouldn’t have them. After all, a Republican senator from Texas is the sponsor!

So, who else (besides the detestable John Cornyn) is sponsoring this anti-constitutional gun control bill? Unfortunately, there are many of them, and some are surprising. However, since we already know for a fact that most Senators do not even read the the bills they pass, I would not be surprised if many of these people don’t even understand what this bill does. Whether or not they understand the bill is irrelevant. They have lent their support to it, and must therefore suffer the political consequences. Here is the list:
