The Governor of California, Jerry Brown, has announced his intent to sue President Trump for rolling back Obama-era regulations of the coal industry.
“First of all we can go to court and block his efforts and we are doing that. Just like the Republicans tried to block Obama’s efforts,” said Brown.
Let me address this briefly. You cannot successfully sue the President for taking an action simply because you do not agree with the policy. A court has no authority to second-guess the President’s policy decision. The only question for the court in such a lawsuit would be whether or not the President had the authority to take this action. In this case, President Trump is simply reversing a regulatory action taken by President Obama. If Governor Brown does make good on his threat to sue, it would almost certainly be without merit. However, since no lawsuit has yet been filed, this is all speculation. We will have to wait and see what, if anything, Mr. Brown’s legal team files in court. Since today’s elected Democrats deal mostly in grandstanding, it would not surprise me if no lawsuit materializes. If one does, it will likely make heavy use of leftist cliches, phony data, and very few substantive legal arguments. That’s just how they roll.
